How can these devices be monitored?

The device can be monitored through an application called “alertire”, installed in your mobile.

How can I download the application?

You can download alertire app from App store in iTunes for iOS and from Google Play Store for Android.

How do the device and the application communicate?

The device has a sensor that communicates with the application via a low energy Bluetooth. As such, it is important that you keep your Bluetooth switched on.

What is the difference between Bluetooth and Bluetooth low energy?

Bluetooth and Bluetooth low energy are two different technologies. Bluetooth low energy is much more efficient in battery utilisation.

What is the use of Bluetooth Low Energy?

Products created with Bluetooth low energy last for several years with just coin cell battery.

Will the device work if the Bluetooth is switched off?

No, the device cannot communicate with the sensor if Bluetooth is switched off.

How is the device tracked by the application installed on the phone?

When you enable the location on your phone, the application will pick up your location and thus allow the sensor to locate your phone. The sensor will then communicate with your application via Bluetooth.

Does it work on GPS?

alertire does not use GPS. It connects using Bluetooth and your location. GPS normally drains out phone battery and is hence not effective.

How is the device charged?

The device is charged through a coin battery.

What is the battery Life?

Battery is expected to last for 5 years depending on the usage.

Is there a warranty for the device?

Yes, the device comes with 1 year warranty.

What is the procedure if the device stops working?

If the product is faulty, it will need to be shipped back to the company. Post investigation, the product will either be repaired or replaced. The product will then be shipped back to you.

What operating system does the app support?

The Application supports Android and iOS.

What version of IOS does the app support?

The Application supports iOS 8+.

What version of Android does the app support?

The Application supports Android version 5 and above.

Do cars have a pressure safety valve?

Yes, every car has a pressure safety valve.

Can the product be sold to anyone else?

Yes, you can sell the product. You need to call customer care and ask them to transfer the vehicle from your account to the account to whom you are going to sell.

What happens to the application if you lose your phone or purchase a new phone?

The sensors are tracked through cloud server, thus allowing you to connect by just installing the application on the new phone and logging with your user id and password.

Will the sensor recognise the application if uninstalled & reinstalled in same or other device?

Yes, the sensor will recognise the device the moment you login with your id and password.

From what distance can the device communicate with the application?

The device can communicate with the application within 10 to 15 meter radius.

How can I know which sensor is in which tire?

To quickly identity the sensor you can deflate the tire and then identify the sensor from the app.

How do we know which device goes into with tire?

Before the sensor is fit into the tire, it has to be configured into the application. In the application you will need to assign or name the tire and then pair the sensor accordingly.

What if the device is fixed to the tire, but does not match with the application?

You will need to physically check the device along with the application and make the changes.

How do I identify which tire the sensor needs to be installed?

First you will need to configure the sensors in the application and then the application will indicate the right sensor to be fixed based on the description provided.

Can the sensor measure Nitrogen?

Yes, the sensor can measure Nitrogen.

What types of sensors are used in the device?

alertire holds both Temperature and Pressure Sensors.

What is the maximum pressure that can be measured in a tire?

The maximum that can be measured is up to 100 PSI

What is the temperature limit SensAiry supports?

The device supports from -40 degree up to 105 degrees.

When should I replace the battery and how?

The battery is part of the product and cannot be replaced. After the life of the battery, the product needs to be replaced.

What is the accuracy of alerTire for pressure and temperature?

Accuracy for pressure is +/- 1 PSI and for temperature +/- 5C.

What are the mandates for the device to communicate with the application?

Bluetooth and location should be switched on for an Android phone and for IOS only Bluetooth will suffice.

Why the location service should be on in the mobile device?

It is forced by the OS itself to enable location in order to scan for BLE beacons, which is very much required to detect the pressure updates irrespective of app running status.

Do Cars have a pressure safety valve?

Yes, every car has a pressure safety valve.

Warranty

These warranty terms set out the warranty policy for product(s) manufactured and sold by AlerTire Technologies Private Limited (‘we’, ‘us’, ‘our’) either by itself or through authorized third parties.

1. WHAT IS COVERED UNDER THE WARRANTY?

  1. This warranty extends only to original, unaltered and unmodified Product(s) bearing the trademark or tradename or logo of the Company. In the event it is found that the components of the Product(s) have been altered or modified in any manner, this warranty ceases to be applicable.
  2. Any inherent defect in the hardware and improper workmanship of the Product for a period of 1 year from the date of purchase of the Product(s).

2. WHAT IS NOT COVERED UNDER THE WARRANTY?

This warranty policy is not applicable under the following circumstances:

  1. Any damage caused due to normal wear and tear, improper installation (each time) and/or use of the Product(s) including any deviation from the user manual provided with the Product(s).
  2. Damage caused due to use of any third party component that does not meet with the technical specifications of the Product(s).
  3. The Company does not warrant that the operation of the Product will be uninterrupted or error free.
  4. Product(s) not purchased through AlerTire or any of the authorized third parties.
  5. This warranty does not cover software embedded in the Product and the services provided by the Company.
  6. Damages arising out of use of the Product(s) in a manner which are not prescribed by us.
  7. Damages caused to the Product(s) due to accident, fire, flood, earthquake and other force majeure events.

3. HOW DO I OBTAIN WARRANTY SERVICE?

    1. You must get your Product(s) registered through your registered account on our Website and fill out a warranty form available there. You may contact our customer care executives on support@AlerTire.com for specific instructions. Please note that you must produce proof of purchase of the Product(s). A proof of purchase may include a dated sales receipt from the Company or a dated official email confirming the purchase and shipment of the Product(s) or an order number that could be referred to, in the Website.
    2. We have a reverse pick up facility. However, this option is not applicable to every area. In the event the pick up facility is not available in your area, you may return the Product(s) to

  1. Please note that our in-house product assessment team will review the defective Product(s) and determine if the complaint raised in relation to the Product(s) is covered under our warranty terms. The decision of our in house product assessment team is final and binding.
  2. The benefits of this warranty service are only applicable to the original purchasers of the Product(s) and are non-transferable. Our warranty terms are three tiered, in order of priority as enumerated: (i) Repair or Service of the Product(s); (ii) Return and Replacement of the Product(s); and (iii) Refund for the purchased Product(s). 4. LIMITATION OF OUR LIABILITY

We and our affiliates, suppliers and agents’ maximum liability pursuant to this warranty policy is limited to the purchase price you paid for the Product(s). Neither are we nor our partners, affiliates, directors or employees are liable for any event beyond our control.

5. GOVERNING LAW & JURISDICTIO

These warranty terms shall be subject to all applicable laws of India. The Courts at Bangalore, India shall have exclusive jurisdiction over all or any disputes arising out of these warranty terms.

Tymtix Return Policy

This Return Policy will set out the terms and conditions governing the return of products purchased from AlerTire Technologies Private Limited (‘AlerTire) or through its authorized reseller or agent.

AlerTire (‘we’, ‘us’, ‘our’) is committed to excellence and we use state-of-the-art techniques in the manufacture and delivery of our every single product. However, on rare occasions, problem may arise due to inherent damage to the product(s), deficient packaging, wrong product(s) being delivered and the like. Such genuine errors will be remedied and the product(s) will be re-delivered to the user as quickly as possible.

1. WHEN ARE YOU ELIGIBLE FOR THE RETURN POLICY?

The following criteria shall be applicable for eligibility of return of our product(s), under this return policy:

  1. The product(s) must be purchased from AlerTire or through its authorized reseller or agent.
  2. The return request must be raised within 7 (seven) days from the date of delivery of the product(s).
  3. The returned product(s) must be accompanied with the original invoice. In the event we receive the returned product(s) without the original invoice, the product(s) will be re-delivered to you and the shipment charges will be recovered from you.
  4. The returned product(s) must not be tampered with or re-designed in any way. In the event we find that the product(s) have been tampered with, your return request will be revoked and your product(s) will be rendered unserviceable and the purchase price paid by you shall stand forfeited.
  5. The returned product(s) must reach our workshop/facility in the same packaging material used in the delivery of the product(s) to you.
  6. You may use the invoice sent to you through email for your reference and quote your invoice number contained therein, to track or receive updates about the product(s).
  7. Any product which is returned is subject to an assessment of our in-house product assessment team. In the event our product assessment team reports that any product is ineligible for any reason, including but not limited to the abovementioned reasons, the return policy will be rendered inapplicable to such product(s).
  8. The decision of our in-house product assessment team in this regard shall be final and binding.

2. WHAT IS THE PROCEDURE?

AlerTire’s return policy will result in any of the following in that order to the product being returned:

  1. Repair or Service of the product(s);
  2. Return or replacement of the product(s); and
  3. Refund of the purchase price.

2.1 Repair or Service of the Product:

  1. Our in-house product assessment team will review the extent of inherent damage in the returned product and confirm whether the damage is serviceable. Please note that the repair of product(s) may take 2 (two) to 4 (four) weeks from the date of receipt of the product(s). An intimation containing a summary of the nature, extent and the estimated date of delivery of the repaired product(s) will be sent to you through your registered email address.
  2. AlerTire reserves the absolute right and discretion in determining the extent and cause of repair of the product(s) and the user acknowledges such assessment of the Company to be final and binding. Repairing the product can involve using new or refurbished parts. AlerTire do not charge any fees for any repairs it undertakes, which are caused due to an inherent defect in the manufacturing process. Further, AlerTire deliver the repaired product(s) free of cost.

2.2 Return or Replacement of the Product:

  1. In the event, the inherent damage to the product(s) is beyond repair you will be eligible for the replacement of your returned product with a new or refurbished product.

2.3 Refund

  1. Our obligations and your eligibility to avail the benefits under this return policy will be determined by our product assessment team. If the product(s) cannot be repaired and/or replaced as determined by our in-house product assessment team, we may provide you a credit note equivalent to the amount of purchase price of product(s) paid by you in lieu of refund, which you may claim/ utilize within the time-line specified thereunder. In the alternate, at our sole option and discretion, we may provide a refund of the purchase price of the product(s) paid by you if the product(s) cannot be repaired and/or replaced as determined by our in-house product assessment team.

2.4 Please note that the above 3 (three) steps (under Clause 2.1 to 2.3) are to be complied in seriatim and must mandatorily follow one another.

2.5 We will keep you updated about the refund status of your returned product(s) from the date of receipt of the same at our workshop/ facility. We initiate the refund procedure within 3 (three) business days of submission of eligibility report by the product assessment team

3. MODE OF RETURN OF THE PRODUCTS

3.1 You may return the product(s) in the following manner:

    In the event the product(s) delivered to you is defective or damaged or is of the wrong description, please return the same with the original invoice and in the same packaging with which you had received it originally. Please note that prior to return, you must contact our customer care executives on support@AlerTire.com (email address) and inform them about the return of the product(s). Our customer care team will assist you by providing the necessary details for the return of the product. We will not accept any product(s) returned without the prior intimation being made to our customer care team.
  2. Return through Self Shipment:

1. AlerTire creates sensor based products that makes everyday life easier. This privacy policy (‘Policy’) discloses the privacy practices of our sensor based products (“Devices”), our websites located at www.AlerTire.com  and our mobile applications (each an “App” and collectively the “Apps”). The Devices, Sites and Apps are collectively referred in this policy as “AlerTire Service”. This Policy applies solely to information collected by AlerTire Service. It will notify you of the following:

  1. What personally identifiable information (‘PII’) is collected from you through the AlerTire Service, how it is used and with whom it may be shared;
  2. What choices are available to you regarding the use of your data;
  3. The security procedures in place to protect the misuse of your PII;

2. What Information Do We Collect?

  1. We collect information from you when you register on our Sites or through our Apps. Your email address is required for registration and this email address will be your account user name to login to AlerTire Service. Your email address is not disclosed to anyone. You have the option to create your account using your Facebook or Google+ account and during this process we will request access to your name, email address and profile picture.
  2. We store information that uniquely identifies the products you purchase and also the data collected by the products you purchased
  3. While purchasing our products from our Sites we request information from you on our Order Form. To purchase a product from us, you must provide contact information (like name and shipping address). This information is used for billing purposes and to fill and deliver your orders. If we have trouble processing an order, we’ll use this information to contact you. Other financial information (like credit card number, expiration date etc.) that you enter in the Order Form are not viewed or stored in our server. This is handled by our third party payment processor who is PCI/DSS compliant.
  4. While you seek help in our forum or post answers to other users queries, the information you post is stored in our server.
  5. When you contact us for help, we collect information such as your name, email address and other support related information to provide effective assistance to resolve your problem.

3. What Do We Use Your Information For?

3.1 Any of the information we collect from you may be used in one of the following ways:

    • To personalize your experience (your information helps us to better respond to your individual needs);
    • To improve AlerTire Service (we continually strive to improve AlerTire Service offerings based on the information and feedback we receive from you);
    • To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs);

      Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested by the customer.
    • To send periodic emails;
      The email address you provide for order processing, may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc.

Note: If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

  • To administer a contest, promotion, survey or other similar feature;
  • To share your de-identified data (Data that does not identify you) to support research purposes and adequate security measures are put in place so as to prevent re- identification of your data;
  • To share your data with a third party and send updates through your Facebook or Twitter account. Once your data gets published on third party apps, it becomes the subject of the third party’s Privacy Policy. However, you may rescind this authorization by accordingly changing your privacy settings on your AlerTire account.
  • Information you shared in our forum may be shared to other users (registered and non- registered).
  • SensAiry app communicates with TPMS sensors using BLE(Bluetooth Low Energy) technology. The app requires Bluetooth and location access in receiving BLE packets to monitor the tire pressure and temperature while the app runs the foreground or background mode. We do NOT save user GPS location data anywhere in the app or server.

6. Cookies

  1. We use “cookies” on our Sites. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our Sites and identify repeat visitors to our Sites. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our Sites. Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of AlerTire Service.

  1. We do not sell, trade, or otherwise transfer to outside parties any PII. This does not include trusted third parties who assist us in operating our Website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our AlerTire Service policies, or protect ours or others rights, property, or safety. However, non- personally identifiable visitor information may be sold or provided to other parties for marketing, advertising, or for other uses.

If you wish to request the deletion of your data associated with AlerTire, you can do so at any time by following the steps below:

  • Navigate to the Orders page.
  • Click the ‘To delete the account click here’ link provided on the page.
  • Confirm your request to permanently delete your data.
  • Once confirmed, your data will be permanently removed from our systems in accordance with applicable laws and our internal data retention policies.

AlerTire Technologies Private Limited (‘Company’), a company incorporated under Indian Companies Act, situated at Gopalan Signature Tower, 2nd Floor, #6, Old Madras Road, Nagavarapalya, C.V.Raman Nagar Post, Bengaluru, KAR 560093 provides online and mobile services including but not limited to our websites located at www.AlerTire.com  and our mobile applications (each an “App” and collectively the “Apps”). The Sites and Apps are collectively referred in this policy as “AlerTire Services”. Please read the following Terms and Conditions (‘T&C’) carefully as the T&C would create a binding legal contractual relationship between you and the Company (‘we’, ‘us’, ‘our’), with respect to the sale, supply and usage of AlerTire products and AlerTire Services.

  • You will access AlerTire Services for lawful purposes and shall abide by all the applicable laws while using AlerTire Services.
  • You will provide authentic and genuine information at all instances, wherever requested. Further, you also authorize us to review any/ all information that you provide to us and in the event such information is proved to be false, you acknowledge our right to revoke your registration, have any amount that you have paid for the product forfeited, and block you from using AlerTire Services.
  • You will access AlerTire Services with full knowledge of and consenting to all the associated risks and you will exercise reasonable care and precaution while transacting through AlerTire Services.
  • You will not use AlerTire Services with an intent to gain unauthorised access to other computer systems or interfere with any other person’s use or enjoyment of AlerTire Services.
  • You will not transmit or store electronic copies of materials protected by copyrights or trademarks without the prior permission from the copyright or trademark owner.
  • You are of legal age to form a binding contract and are not a person barred from receiving services under the laws as applicable in India.

8. PROPRIETARY RIGHTS

  1. AlerTire Services contains copyrighted material, trademarks and other proprietary information. You may not alter, modify, transmit, publish, create or derivate works and/or any of the content on AlerTire Services.
  2. Further, you acknowledge that using AlerTire Services does not entitle you to assume any trademark or copyrighted information which is listed on AlerTire Services is in public domain, and that it is for the exclusive use or benefit of the Company.

9. INDEMNITY

  1. You will indemnify and hold harmless the Company and its officers, directors, employees and agents from and against any claims, disputes, demands, damages and expenses, including attorney’s fees arising out of or in any way connected with your use to AlerTire Services and your breach of these T&C.

10. ENTIRE UNDERSTANDING

  1. If any part of these T&C is determined to be invalid or unenforceable pursuant to applicable laws including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the T&C shall continue in effect.
  2. Unless otherwise specified herein, these T&C and other AlerTire Services policies constitute the entire agreement between you and the Company, with respect to AlerTire Services, AlerTire Product and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and us with respect to the Company.
  3. Our failure to act with respect to a breach by you does not waive our right to act with respect to subsequent or similar breaches.

General Terms & Conditions For Sale & Delivery Of SensAiry

These terms and conditions of sale and delivery of SensAiry (‘T&C’) are applicable to all agreements, between AlerTire Technologies Private Limited (‘Seller’) and a buyer purchasing its product(s) and/or service(s) through its website or app (‘Buyer’).

1. DEFINITIONS

  1. ‘Buyer’ means the person to whom the Seller is selling the product(s).
  2. ‘Contract’ means these Terms and Conditions read with the Website T&C, return policy, warranty terms, privacy policy and all such additional terms and documents, between Seller and Buyer for the sale and purchase of product(s).
  3. ‘Order’ means Buyer’s order for the product(s) as set out in the Website (as defined below)
  4. ‘Product(s)’ means the goods, parts, products, deliverables, items and/or services provided by Seller to Buyer pursuant to the Contract.
  5. ‘Seller’ means AlerTire TECHNOLOGIES PRIVATE LIMITED having its registered office address at Gopalan Signature Tower, 2nd Floor, #6, Old Madras Road, Nagavarapalya, C.V.Raman Nagar Post, Bengaluru, KAR 560093.
  6. ‘T&C’ means the terms and conditions set out in this document as amended from time to time
  7. ‘Website’ means the domain www.AlerTire.com designed specifically to display and list the product(s) and/or service(s) of the Seller
  8. ‘Writing’ includes facsimile transmissions, e-mail and comparable means of communication. Any notice and/or other communication in writing required to be given by one party to the other shall be addressed to that other party at its registered office or principal place of business.

2. CONTRACTUAL OBLIGATIONS

  1. An Order is deemed to be an offer if the Buyer registers himself/ herself for the purchase of Product(s) on the Website.
  2. The Order will be deemed to have been accepted when the Buyer receives a written acceptance from the Seller.
  3. Any changes or alterations with respect to the mode of payment, quality, quantity, shipping of Product(s) shall be intimated to the Seller in writing, (prior to dispatch of Product by the Seller) and such changes will be deemed to have been acknowledged by the Seller, upon a written confirmation of the same from the Seller.

3. PRICING & PAYMENT MECHANISM

  1. The price of Product(s) is subject to the discretion of the Seller. Further, the Seller reserves the right to change the price of the Product(s), after the placement of the Order by the Buyer.
  2. If the price change occurs before the shipment of the Product(s) to the Buyer, the Seller shall communicate to the Buyer through the contact details (telephone number and e-mail) provided by the Buyer, about such change being made to the price, and await instructions with respect to the delivery of the Product(s).
  3. If the Buyer accepts the change in price of the Product(s), the Seller shall dispatch the Product(s) to the address provided by the Buyer after receiving the amount, based on the payment method chosen by the Buyer. However, this change in pricing is not applicable to Product(s) that have already been dispatched to the Buyer’s address.
  4. The Buyer shall provide accurate and true information with respect to his payment details (credit card/ debit card/ net banking accounts). In the event, the Seller does not receive authorisation from banks or the transaction gets interrupted due to any fraudulent or illegal reason attributable to the Buyer, such transaction will be considered as cancelled and the Seller reserves the right to initiate legal proceedings against such Buyer(s) to recover damages, losses and other expenses.

4. PRODUCT

  1. Installation

    The Buyer must install the Product(s) only in terms of the user manual provided with the Product(s). Please note that if the installation of the Product(s) is done without following the user manual guidelines, the sensor in the Product(s) may get damaged due to such mishandling and improper installation. The said user manual guidelines for installation are applicable not only to the first installation but also to subsequent installations at any time including without limitation during wheel balancing/rotation/alignment. The Seller shall not be liable for any damage to the Product(s) arising due to improper installation by the Buyer.

  2. Tampering

    The Product(s) must not be used for any other purpose other than for its intended usage as permitted by the Seller. The Seller shall not be liable in any manner for any sort of tampering with the Product(s) by the Buyer with an intention of using it for other purposes (not being for the intended purpose).

  3. App

    The Product(s) shall function with an accompanying application supported by a smart phone (as may be compatible with specific operating systems like IOS, Android, Windows) (‘Mobile App’). The said Mobile App shall also be provided as a website application accessible through a computer device (‘Web-App’). The Website T&C shall be applicable to the App and the Web-App.

  4. Functionality

    1. The Product(s) shall perform in an optimum manner when used in accordance with the user manual. The Seller shall not be liable in any manner whatsoever in the event the Product(s) is installed and/or used in any other manner and not in accordance with the user manual. The Seller shall not be liable in any manner whatsoever for any effect/ damage on any other parts (including the tyres) of the automobile in which the Product is installed.
    2. The Product(s) can only be used on tubeless tyres. The Product(s) and the Mobile App function within a distance of 10 (ten) meters only. This distance could be affected based on the vehicle in which the sensors are installed, weather conditions and phone in which the app is installed etc.
    3. 1 (one) Product device can be installed and used only on 1 (one) tyre in an automobile. Therefore, a 2 (two) wheeler vehicle shall require 2 (two) Product(s). However, the accompanying Mobile App shall provide the data in relation to all the Product(s) installed in a consolidated manner per automobile. Therefore, it is clarified that irrespective of the number of Product(s) installed in an automobile, the Buyer shall only require one accompanying Mobile App per automobile.
    4. The compatibility of the Product you are purchasing with your mobile phone, vehicle type, tire type etc. must be determined by you and you accept that lack of compatibility is not valid under the warranty or refund policy.
    5. The Seller does not provide any of the following in relation to the Product(s)
    6. The Seller does not provide any of the following in relation to the Product(s):
      1. Installation services;
      2. Wheel balancing and alignment services; and
      3. After sales services (except the services provided under our return policy)

5. DELIVERY

  1. The Buyer will receive an email containing the particulars of the Order placed by him and the estimated time of delivery of the Product(s), immediately upon placing the Order. The time taken in delivering the Product(s) depends on various factors such as demography of the delivery destination of the Product(s) including but not limited to transportation and infrastructural facilities available to the Seller or its delivery executives to reach the designated delivery destination. Time is not the essence of delivery of the Product(s).
  2. In the event, the delivery of the Product(s) is delayed due to unforeseen circumstances, the Seller will contact the Buyer through e-mail or short messaging service (SMS). However, the Seller will not be responsible for any liability, damages or expenses arising out of or due to incorrect information provided by the Buyer at the time of placing the Order.

6. CANCELLATION OF ORDERS

  1. Cancellation by the Seller

    1. The Seller reserves the right to cancel any Order, prior to and post acceptance of such Orders due to errors in description and pricing of any Product(s) or any problems identified by the payment partners or banks of the Seller, attributable to the Seller. In such event the Buyer is entitled to a credit note. Such credit note shall be valid for a tenure of 3 (three) months and the Buyer can place an Order for the Product(s) using such credit note within the stipulated time period, in case that the payment for the Order has already been made.
    2. The Seller shall contact and inform the Buyer if all or any part of the Order has been cancelled, and provide reasons for the same.
  2. Cancellation by the Buyer

    1. The Buyer is not entitled to cancel the Order, once the same has been placed, at any time thereafter. However, the return of an Order by a Buyer, in accordance with the policies of the Company, is permitted in the event the Buyer returns the Order after it has been delivered to the Buyer’s address on account of receiving damaged Product(s), or Product(s) of wrong description. In such cases the return policy shall be applicable as provided here www.AlerTire.com/return-policy.

7. PROPRIETARY RIGHTS

  1. The Product(s) delivered by the Seller have been copyrighted under the applicable laws. The delivery of the Product(s) to the Buyer does not provide the Buyer with a right to modify, reverse engineer, develop, or re-market the Product(s). Further, the Buyer acknowledges that all intellectual property rights in the Product(s) are owned exclusively by the Seller. The Seller shall reserve its right to initiate legal proceedings against the Buyer for any infringement of its proprietary rights by the Buyer.

8. INDEMNITY

  1. The Buyer agrees to indemnify the Seller and its directors, employees, agents, affiliates from any third party claims, liability, damages or costs that would arise out of breach of these T&C or infringement of any intellectual property rights.

9. GOVERNING LAW & DISPUTE RESOLUTION

  1. The Buyer agrees that any dispute between the Buyer and the Seller arising out of these T&C, or the Contract in connection with the Product(s) (‘Disputes’) will be governed by the law of arbitration in the manner provided below. The courts at Bangalore, India shall have jurisdiction over the disputes arising out of these T&C.
  2. The Buyer and the Seller shall proceed to resolve any Dispute by way of negotiation and compromise without initiating legal proceedings. In the event of failure of negotiation, the Buyer and the Seller agree to resolve any Disputes through arbitration. The arbitration proceedings shall be presided over by a single arbitrator appointed by the Seller. The decision of the single arbitrator shall be final and binding. The arbitration proceeding shall be in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted in English language and shall be held in Bangalore.

10. GENERAL TERMS

  1. The Buyer shall not assign these T&C, without the prior written consent of the Seller. The Seller may assign or transfer these T&C without any restriction.
  2. The Seller’s failure to enforce any right or provision of these T&C will not be considered waiver of such right or provision. Any such waiver of a right or provision shall be valid only upon a written authorisation provided by an authorised signatory of the Seller.
  3. If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
  4. The headings in these T&Cs are for convenience only and shall not affect their interpretation.
  5. The Contract shall constitute the entire understanding between the Seller and the Buyer with respect to the Product(s) offered by the Seller, and the Contract including (T&C) supersedes any and all prior oral or written understandings or agreements between the Seller and the Buyer.

11. LIMITATION OF LIABILITY

  1. In no event will AlerTire be liable for exemplary, punitive, consequential, special or incidental damages including but not limited to loss of revenue, use, profits, or costs of procuring substitute products arising out of relating to or in connection with the purchase, sale, use, operation or performance of the product. The maximum liability of the Seller its affiliates, suppliers and agents pursuant to this T&C is limited to the purchase price paid by the Buyer for the Product, only in the event of default attributable to the Seller. The Seller and its partners, affiliates, directors or employees are not liable for any event beyond the control of the Seller

12. DISCLAIMER

  1. Please note that the Seller does not make any warranty as to the completeness, quality, timeline, for delivery of Product(s) under these T&C. Further, the Seller disclaims any/all liabilities for damages arising out of improper installation and use, misuse, abuse or any damages caused due to the normal wear and tear of the Product(s), earthquake, floods or any other natural calamity or expenses including but not limited to courier charges and legal fees. Notwithstanding the factors mentioned and the time-lines specified herein, the maximum liability of the Seller under the T&C is limited to the purchase price of the Product(s) paid by the Buyer.
